The firmware is undetectable, so you can still play online on xbox Live. However, Microsoft can detect actions you perform on your console, like playing games before they come out, or copies of games that are not exact 100% 1 for 1 copies. People are also talking about the fact that different brands of drives make the mod more detectable on xbox live. MS hasn't done any rounds of bannings recently, so we cannot confirm this. OzModChips has no warranty at all on users getting banned from xbox Live.
